Windows Vista End User License Agreement, What’s
wrong, What’s correct
The Microsoft Windows Vista was released on 30th November
2006 to its business customers. Before release, Windows
Vista was making noise among Windows users. The first
reason for the same was that, the prices were set high.
The second was the EULA (End User License Agreement).
Vista EULA with 2 options – accept or decline
The EULA is an agreement of contract between the producer
of product and the end user which gives exclusive rights
to use the software. This document describes or defines
the bounds in which the user can install, use the software.
There are many terms and conditions in the EULA regarding
using, installing, uninstalling. Some software including
Windows displays the EULA terms and conditions during
installation process. This EULA display screen prompts
the user with two options. The first option is to accept
the End User License Agreement and proceed to install
and make use of the software. The second option is to
decline to agree the EULA terms. When one declines this
at this stage, the software quits and will not get installed
at all. The user can try to install the software later
or can return back the software to the vendor from which
the software was purchased.
License restrictions
The controversy in EULA of Windows Vista is, it creates
license restrictions, according to some users. The criticism
was that the license agreement has not been expressed
properly, in the area of component change. This confusion
leads to license restrictions according to some users
of Windows Vista. In the backdrop of this criticism,
Microsoft has modified the license terms in the areas
of component changes, to be less restrictive.
When Microsoft released the EULA for Windows Vista,
the new operating system, users were made to press the
panic button because of fault in the EULA according
to software gurus, analysts. The snag was in the hardware
component area, where the statement said, that the users
who upgrade to new machines, might have to purchase
a new license, if they upgrade the system components
more than once. This allowed the user to use/transfer
the license only once.
Some argued that the terms given in the license prevent
one from adding a new hardware after Windows Vista got
installed in their systems. Hardware engineers and other
people, who change the components of the system regularly,
were made to fear that they need to purchase a new copy
of Windows Vista, whenever they change the hardware.
EULA modifications
In response to hue and cry, Microsoft modified EULA
to state “You may uninstall the software and install
it on another device for your use. You may not do so
to share this license between devices.” This resulted
in one change, i.e. one can use the software in different
system, on condition that, the software should be removed
from the existing system. The users who buy preinstalled
copies of Windows Vista are not affected.
You can’t satisfy everybody
Jupiter’s Wilcox pointed that, little has changed
in EULA. He said that, “You can’t satisfy
everybody”. He also said “In some ways,
Microsoft listens too much, and as a result, its products
suffer. You can't please everybody, but they're still
trying to."
Anti piracy policy
The anti piracy policy of Microsoft is good and intelligent
one. The product is verified for its genuineness within
some days after the product installed. This process
will reduce the use of pirated software among the users
of Windows Vista.
Think of common man before deciding price
But, as far as prices are concerned, the price of Windows
Vista Ultimate edition is too high. It is the Ultimate
edition which offers all new features of Vista. It is
too expensive, such that, one needs to spend half the
amount, at which they purchased PC. So, one may go for
free licensed operating systems here after. One may
argue that, Microsoft is spending heavily on developing
Windows operating system. But, they should keep in mind
that, the product is not for single organization. It
is for multiple organizations, and common people. Common
man, who uses computer for something, will think about
the prices and the number of features that the product
offers, before purchasing any edition of Windows Vista.
Let Microsoft specify and make sure that the product
purchased in India is not used outside India. Microsoft
can release another separate product of Windows Vista
for Laptops, which enable one to take, make use of the
product beyond Indian boundaries. Also, Microsoft should
keep in mind is that they can make and sell any number
of copies of Windows Vista among users. Do you think
